What does the fictitious status mean in the maternity and paternity income tax application?

Have you already requested the return of the overcharged maternity and paternity income tax? In case you haven't found out yet, you should know that fathers and mothers who had children between 2014 and 2018 have the right to obtain the unduly paid, according to a Supreme Court ruling.

Last week, the Government launched a rapid procedure to return the amount as soon as possible to all taxpayers who paid it without it being necessary. The first to be able to request it will be those who received the benefits in 2014 and 2015 . As of January, those who had their children in 2016 and 2017 will be able to do so. Those in 2018 will not have to do anything, because the Tax Agency will settle accounts with them in the 2018 Income Statement, whose campaign will begin in April 2019.

Many have already petitioned for their case to be reviewed. More than 30,000 fathers and mothers in the first hours since the procedure began. However, some have observed with surprise that when checking the status of their petition, it indicated Fictitious Status.

What does Fictitious Status mean in the maternity and paternity income tax application?

The answer is nothing. We have also verified that since last weekend, the status of our application was Fictitious Status. The surprise of the taxpayers who had already made the request to the Treasury was capital, because the truth is that it is a state to say the least disturbing.

In social networks they did not take long to echo the mysterious state. But the truth is that the matter does not have much substance. Today we have called the Tax Agency to inform us about the meaning of that status. All they have told us is that it is a computer error, which has caused the famous "fictitious state" to appear as such in the system. And that taxpayers have been able to read precisely this when checking the status of their applications.

In reality it was a generalized ruling, which has affected the common of the taxpayers who had already requested the return of income tax for the benefit . This means that in reality, we were facing an error, but that it had nothing to do with the status of the benefits.

In fact, many people believed that it was a refusal of return. Nothing could be further from the truth. From the Tax Agency they confirm to us that this Fictitious State has nothing to do with reality and that all applications continue their course. What you have to do from now on is wait.

Status of the return of income tax for maternity and paternity

If you have not yet checked the status of the return or want to see if the Fictitious Status that we mentioned to you has already disappeared, all you have to do is access the page that the Tax Agency has enabled for this purpose.

Click on Other procedures to access the Status Query processing of request for IRPF rectification for maternity / paternity benefit . Here you will have to identify yourself with your reference number and DNI to, then, finish confirming the DNI of the taxpayer in question.

You will see the application and its status (applications, if the maternity and paternity benefit coincided in two years, 2014 and 2015), which by now should have changed. We have been able to verify that right now there is no Fictitious State, but a Review in process , which must mean that the process is proceeding normally.
